Terms of sale

These terms apply to ChiptunePRO subscriptions taken out by professionals. They supplement the terms of use; in case of conflict, they prevail for paid services. The French version is the reference version.
1. Parties
The ChiptunePRO service (app.chiptunepro.com) is provided by Benjamin Fargeot, sole trader (entrepreneur individuel, EI), SIRET 940 859 457 00019, 2 rue du Général Louis Clouet, 33650 La Brède, France, contact@chiptunepro.com (the "Publisher").
The "Customer" is the professional who creates a ChiptunePRO account.
The contract consists of these terms of sale, the terms of use, the data processing agreement and the description of the plans on the pricing page on the day of subscription. The Customer accepts them by creating an account (checkbox, or the notice shown under the "Continue with Google" button) and by subscribing. The date and version accepted are recorded.
2. Professionals only
ChiptunePRO is intended exclusively for professionals acting for the purposes of their business (garages, tuners, remapping specialists). By creating an account or subscribing, the Customer declares that they act as a professional. Consumer protection rules, including the right of withdrawal, therefore do not apply.
3. The service
Depending on the plan, ChiptunePRO includes: a listing on the ChiptuneMAP directory, customer and vehicle management, power gains and ethanol simulators and a contact form to embed on the Customer's website, quotes and invoices, a calendar and other tools described on the pricing page.
The gains shown by the simulators are indicative estimates. The Customer checks and adjusts them before presenting them to their own customers.
The Publisher keeps improving the service. If it removes an essential feature from a paid plan, it notifies the Customer at least 30 days in advance; the Customer may then cancel at no cost.
4. Plans and prices
- Starter: free, with no time limit and no credit card, with the features and limits shown on the pricing page.
- Paid plans: monthly or yearly subscription, at the prices and with the content shown on the pricing page at the time of subscription.
- Prices: in euros, net. VAT not applicable, article 293 B of the French General Tax Code. A promotional code entered at checkout may reduce the price.
- Price changes: any price change is announced by email at least 30 days before it applies, at the next renewal. A Customer who does not accept it may cancel before that date.
5. Trial period
No paid-plan trial is offered at present: the Starter plan lets you try ChiptunePRO for free.
If a trial offer is made, its length and conditions are shown before subscribing. At the end of the trial, the subscription becomes paid unless cancelled before the trial ends.
6. Payment and invoices
Payment is made online through Stripe, by card or another method offered on the payment page. The Publisher never has access to card numbers.
The subscription is payable in advance, at the start of each period (month or year). An invoice is issued for each payment.
7. Term, renewal and cancellation
- Term: a monthly subscription runs for one month, a yearly subscription for one year, from payment.
- Renewal: it renews automatically for the same term, at the current price, unless cancelled before the renewal date.
- Cancellation by the Customer: at any time, from the subscription settings of their account, at no cost and without giving a reason. It takes effect at the end of the paid period; access to paid features continues until then, after which the account returns to the Starter plan.
- Changing plan: possible at any time from the account, under the terms shown when making the change.
8. "Lifetime" offer
When offered, the "lifetime" offer is paid once and gives access to the features of the plan stated at purchase, with no recurring payment.
"Lifetime" means the period during which the Publisher operates the ChiptunePRO service, not the life of the Customer or of their business. The offer is attached to the Customer's account and cannot be transferred. Features evolve as for the other plans.
If the Publisher permanently shuts down the service, it notifies the Customer at least 6 months in advance and lets them retrieve their data.
9. Failed payment
If a payment fails, Stripe retries it and the Customer is asked to update their payment method; access continues during these attempts. If payment does not succeed, the subscription ends and the account returns to the Starter plan. The data remains in the account.
10. Refunds
Amounts paid are not refundable, including when cancelling during a period, unless the law requires it or these terms provide for it.
11. Availability and support
The Publisher makes its best efforts to keep ChiptunePRO accessible and working properly (best-efforts obligation). No availability level is guaranteed. The service may be interrupted for maintenance, where possible outside usual working hours, or in case of an incident.
Support is provided by email at contact@chiptunepro.com and from the application, as soon as possible. The Pro plan receives priority handling.
12. Customer's commitments
- Information: provide accurate information and keep it up to date.
- Access: keep their credentials confidential; any action taken from their account is deemed taken by them.
- Content: the Customer alone is responsible for the content they publish or send with ChiptunePRO (texts, images, prices, quotes, invoices, directory listing) and for its accuracy.
- Business: the Customer alone is responsible for the lawfulness of the services they offer and perform, in particular regarding vehicle type-approval, emissions and safety rules, and for their accounting and tax obligations (their invoices remain their own).
- Their customers' data: the Customer is the controller of their own customers' and prospects' data. They inform them, in particular on their website next to the embedded contact form (a template notice is included in the data processing agreement).
- Fair use: do not copy or resell the vehicle database, do not bulk-extract data from the service, do not attempt to compromise its security, and do not use it to send unsolicited messages.
13. Personal data
For the data of their customers and prospects, the Customer is the controller and the Publisher is their processor. The data processing agreement is part of the contract.

14. Intellectual property
The ChiptunePRO software, its simulators and its vehicle database remain the property of the Publisher. The Customer receives a personal, non-exclusive and non-transferable right of use for the duration of their subscription or free account.
The Customer keeps ownership of their content. They authorise the Publisher to host, reproduce and display it as needed for the service, including on their ChiptuneMAP listing and in the simulators embedded on their website.
15. Liability
The Publisher is only liable for direct and foreseeable damage caused by a breach of its obligations. Its total liability, for all events combined, is limited to the amounts paid by the Customer in the 12 months before the event giving rise to liability.
Indirect damage is excluded, in particular loss of revenue, customers, reputation or opportunity, as well as loss of data the Customer could have kept themselves (for example by exporting their invoices).
The Publisher is not liable for the Customer's content, the estimates the Customer presents to their customers, the services they perform, interruptions of third-party services (Google, Stripe, email providers, the internet) or force majeure.
These limits do not apply in case of gross negligence or wilful misconduct, or where the law prohibits them.
16. Suspension and termination by the Publisher
If the Customer breaches their obligations, the Publisher gives them formal notice by email to remedy the breach within 15 days. If it is not remedied, the Publisher may suspend the account or terminate the contract.
The Publisher may suspend an account immediately in case of fraud, clearly unlawful content, a risk to the security of the service or its users, or non-payment. It tells the Customer the reasons by email.
If the Publisher terminates without fault on the Customer's part, the paid and unused portion of the subscription is refunded.
17. End of contract and data
The Customer can delete their account from their settings, once any paid subscription has been cancelled. Deletion takes effect 30 days after the request and can be cancelled until then.
Before deletion, the Customer can export their invoices from the invoicing module and ask contact@chiptunepro.com for a copy of their other data (customers, vehicles, quotes) in a common format. The data is then erased, except for the records the Publisher must keep (its own invoices).
18. ChiptuneMAP directory
Each account has a free listing on the public ChiptuneMAP directory (chiptunemap.com), where drivers find a professional and send them requests. The Customer completes their listing and can hide it at any time from their account.
- Listings shown: only verified and visible listings appear.
- Ranking: by default, listings are sorted alphabetically by company name. When the driver enters a location or shares their position, they are sorted by distance. The driver's filters (country, region, search by name or city, service searched) narrow the list; listings offering the service searched come first.
- No paid ranking: no payment, plan or commission currently influences the position of a listing. If this changes, the Customer is informed at least 15 days in advance.
- Requests received: the Customer finds the requests sent from their listing in their account.
- Removal or suspension of a listing: the Publisher may hide a listing whose information is inaccurate or unlawful, that does not correspond to a tuning professional, or whose holder breaches these terms. It gives the Customer the reasons no later than when the measure takes effect. If it decides to stop listing a Customer altogether, it notifies them at least 30 days in advance, unless required by law or in case of repeated breaches.
- Complaints: the Customer can contest a decision or ask a question at contact@chiptunepro.com.
- Changes: any change to the directory rules is notified at least 15 days in advance.
19. Referral programme
The Customer can recommend ChiptunePRO to other professionals with their referral link. They receive a commission on the first payment of each referred customer, at the rate, payment schedule, minimum threshold and conditions described on the referral programme page.
Referring one's own account is prohibited. No commission is due if the referred customer's payment is refunded or disputed. The referrer declares the commissions received themselves. The programme may be changed or ended with reasonable notice; commissions already earned remain due.
20. Changes to these terms
The Publisher may change these terms. It informs the Customer by email or in the application at least 15 days before they take effect. A Customer who does not accept them may cancel their subscription before that date, at no cost. The applicable terms are always those published on this page.
21. Governing law and disputes
The contract is governed by French law.
In case of difficulty, the parties first seek an amicable solution; the Customer writes to contact@chiptunepro.com.
Failing agreement, any dispute between professionals relating to the contract falls under the exclusive jurisdiction of the courts of Bordeaux (France), including where there are several defendants or third-party claims.
